  3. This Privacy Policy governs your use of the PSIQED platform (the “Platform”), including counseling sessions, the mental health blog, and any related services. By using PSIQED, you agree to this Policy, which is designed in accordance with UAE Federal Law No. 45 of 2021 on Personal Data Protection (PDPL) and aligned with GDPR principles for international best practice.
  4. 2. Scope of Services
  5. Life Coaching & Counseling Sessions: Delivered exclusively through Doxy.me, a GDPR- and HIPAA-compliant telehealth provider.
  6. Educational Blog & Resources: Provided for general informational purposes only and do not constitute clinical advice or diagnosis.
  7. Product Recommendations & Links: May include books, wellness items, or third-party services. These are non-binding lifestyle suggestions; PSIQED accepts no liability for their use.
  8. PSIQED provides an online platform designed to facilitate psychological counseling and life coaching sessions with qualified independent professionals. All counseling sessions are conducted exclusively through secure telehealth software (currently Doxy.me) to ensure compliance with GDPR, HIPAA, and UAE data protection regulations.
  9. It is important to note that PSIQED is not itself a healthcare provider. We act solely as a technological facilitator, connecting users with licensed professionals and providing the necessary infrastructure for remote communication. The responsibility for the quality, accuracy, and effectiveness of any counseling or coaching lies exclusively with the independent therapist.
  10. In addition to counseling services, the Platform also hosts a mental health blog and related digital resources. These materials are intended for general informational and educational purposes only. They do not constitute medical advice, clinical diagnosis, or therapeutic treatment, and should not be relied upon as a substitute for professional care. Users are strongly encouraged to consult a qualified healthcare professional for any individual health concerns. PSIQED accepts no liability for reliance on blog content.
  11. PSIQED may, from time to time, recommend or display third-party products, services, or affiliate links (including books and wellness items). These recommendations are provided strictly for informational and lifestyle purposes. PSIQED does not manufacture, endorse, or warrant these products. Any purchase or use of third-party items is undertaken entirely at the user’s own risk. PSIQED shall not be held liable for any loss, side effect, or damage arising from the use of such third-party products or services.
  12. 4. Purpose & Legal Basis of Processing
  13. We process your data for:
  14. Providing counseling and coaching services (Art. 6(1)(b) GDPR equivalent – contract performance).
  15. Ensuring secure telehealth communication via Doxy.me (legitimate interest).
  16. Billing and enforcing cancellation/no-show policies (contract performance).
  17. Educational outreach via blog posts and newsletters (consent).
  18. Compliance with UAE regulatory and legal obligations.
  19. We do not sell or commercialize personal data.
  20. Third Party Content
  21. The Platform may contain other content, products or services which are offered or provided by third parties (“Third Party Content”), links to Third Party Content (including but not limited to links to other websites) or advertisements which are related to Third Party Content. We have no responsibility for the creation of any such Third Party Content, including (but not limited to) any related products, practices, terms or policies, and we will not be liable for any damage or loss caused by any Third Party Content.
  22. 5. Data Retention
  23. At PSIQED, we are committed to handling personal data in a manner that is both lawful and transparent. We retain information only for as long as is strictly necessary to deliver our services, comply with applicable legal obligations under UAE law, or protect our legitimate interests. Thereafter, data is either securely deleted or irreversibly anonymized.
  24. Session Data – Information arising from therapeutic interactions is retained solely to ensure continuity of care and to comply with statutory obligations. Such data will never be stored beyond seven (7) years, unless a shorter period is mandated under UAE law. After this period, all records are securely deleted or anonymized.
  25. Technical and Usage Data – Data such as IP addresses, device identifiers, and platform usage metrics are retained for a maximum of twenty-four (24) months. After this period, the data is anonymized and used only for security monitoring or statistical analysis.
  26. Financial Data – Payment and transactional information is retained in line with UAE accounting and tax regulations, typically for five (5) years, after which it is securely erased or anonymized.
  27. Deletion Requests – You have the right to request deletion of your data at any time. However, we may be legally obliged to retain certain categories of data for compliance, dispute resolution, or enforcement of agreements.
  28. 5.1 Third-Party Access and Processing
  29. We limit access to personal data to those third parties who are essential for the functioning of our Platform, each bound by strict contractual safeguards:
  30. Therapists – Independent professionals engaged through the PSIQED Platform. They may access only the information strictly necessary to provide services to their clients. Each therapist is contractually obligated to maintain confidentiality and to comply with relevant professional standards.
  31. Doxy.me – All video consultations are conducted exclusively through Doxy.me, a HIPAA-compliant and GDPR-aligned telehealth provider. A Data Processing Agreement (DPA) is in place to ensure the highest standards of confidentiality, end-to-end encryption, and data protection.
  32. Payment Providers – We use only reputable international providers such as Stripe and PayPal to process financial transactions. These providers operate under PCI-DSS compliance, and PSIQED itself does not store raw payment card data. Transfers outside the UAE or EEA are safeguarded under Standard Contractual Clauses (SCCs) or equivalent mechanisms.
  33. Affiliates and Partners – Our mental health blog and product recommendations are intended solely for self-education and voluntary engagement. No health-related data is ever shared with these affiliates. Engagement with external products or content is entirely at the user’s discretion, and PSIQED assumes no liability for third-party offerings.
  34. 5.2 International Data Transfers
  35. In cases where data must be transferred outside the UAE or the European Economic Area (EEA), PSIQED ensures that such transfers are protected by legally recognized safeguards, including Standard Contractual Clauses (SCCs) or binding corporate rules. These measures guarantee that your personal data receives a level of protection equivalent to that provided under GDPR and UAE federal data protection law.
  36. Therapist Requirements
  37. For U.S.-based Therapists
  38. We require every Therapist providing services through the PSIQED Platform to be an accredited, trained, and experienced licensed U.S. professional. This includes:
  39. Licensed Psychologists (PhD / PsyD)•Licensed Marriage and Family Therapists (LMFT)
  40. Licensed Clinical Social Workers (LCSW)
  41. Licensed Professional Counselors (LPC)
  42. Or a similar applicable professional license recognized in their jurisdiction.
  43. All U.S.-based Therapists must:
  44. Hold a relevant academic degree in their field.
  45. Have at least 3 years of professional experience.
  46. Have completed at least 1,000 hours of direct, hands-on practice.
  47. Be qualified and certified by their respective professional licensing board, having successfully completed the required education, exams, training, and practice obligations under their state/jurisdiction.
  48. Privacy and Security
  49. Protecting and safeguarding any information you provide through the Platform is extremely important to us. Information about our security and privacy practices can be found on our Privacy Policy available at betterhelp.com/privacy (The ‘Privacy Policy’).
  50. BY AGREEING TO THIS AGREEMENT AND/OR BY USING THE PLATFORM, YOU ARE ALSO AGREEING TO THE TERMS OF THE PRIVACY POLICY. THE PRIVACY POLICY IS INCORPORATED INTO AND DEEMED A PART OF THIS AGREEMENT. THE SAME RULES THAT APPLY REGARDING CHANGES AND REVISIONS OF THIS AGREEMENT ALSO APPLY TO CHANGES AND REVISIONS OF THE PRIVACY POLICY.
  51. If you are accessing the Platform under the Insurance Offering, then you agree that you have read, understood, and agreed to the Notice of Privacy Practices available at this link.
  52. Therapist Services
  53. The Therapists are independent providers who are neither our employees nor agents nor representatives. The Platform’s role is limited to enabling the Therapist Services. The Company does not itself provide Therapy Services and is not a healthcare entity. The Therapists themselves are responsible for the performance of the Therapist Services. If you feel the Therapist Services provided by the Therapist do not fit your needs or expectations, you may change to a different Therapist who provides services through the Platform.
  54. IF YOU ARE THINKING ABOUT SUICIDE OR IF YOU ARE CONSIDERING HARMING YOURSELF OR OTHERS OR IF YOU FEEL THAT ANY OTHER PERSON MAY BE IN ANY DANGER OR IF YOU HAVE ANY MEDICAL EMERGENCY, YOU MUST IMMEDIATELY CALL YOUR LOCAL EMERGENCY SERVICES NUMBER AND NOTIFY THE RELEVANT AUTHORITIES (click here for a link to emergency and crisis resources in your area). THE PLATFORM IS NOT DESIGNED FOR USE IN ANY OF THE AFOREMENTIONED CASES AND THE THERAPISTS CANNOT PROVIDE THE ASSISTANCE REQUIRED IN ANY OF THE AFOREMENTIONED CASES. IF YOU PROCEED TO USE THE PLATFORM NOTWITHSTANDING THIS NOTICE, YOU DO SO ENTIRELY AT YOUR OWN RISK.
  55. THE PLATFORM IS NOT INTENDED FOR THE PROVISION OF CLINICAL DIAGNOSIS REQUIRING AN IN-PERSON EVALUATION AND YOU SHOULD NOT USE IT IF YOU NEED ANY OFFICIAL DOCUMENTATION OR APPROVALS FOR PURPOSES SUCH AS, BUT NOT LIMITED TO, COURT-ORDERED THERAPY OR EMOTIONAL SERVICE DOG CERTIFICATION. IT IS ALSO NOT INTENDED FOR ANY INFORMATION REGARDING WHICH DRUGS OR MEDICAL TREATMENT MAY BE APPROPRIATE FOR YOU, AND YOU SHOULD DISREGARD ANY SUCH ADVICE IF DELIVERED THROUGH THE PLATFORM.
  56. DO NOT DISREGARD, AVOID, OR DELAY IN OBTAINING IN-PERSON CARE FROM YOUR DOCTOR OR OTHER QUALIFIED PROFESSIONAL BECAUSE OF INFORMATION OR ADVICE YOU RECEIVED THROUGH THE PLATFORM.
  57. 7.1 Therapy Services in Germany & the Netherlands
  58. Therapists in Germany and the Netherlands must not diagnose, treat, test, advise, counsel, recommend a course of treatment, or otherwise provide or perform any services that would exceed the scope of their practice or amount to performing a service that is insured and/or tariff regulated. The Therapist Services are not intended to be reimbursable or covered by insurance or government rebate (whole or in part).
  59. 7.2 Professional Eligibility and Background Screening
  60. Every non-U.S. based Therapist engaged through the PSIQED Platform is required to satisfy the highest international standards of psychological education and professional conduct. As a minimum threshold, therapists must have successfully completed no less than five years of academic training in psychology, culminating in the award of a Master of Science (M.Sc.) degree in Psychology, or an equivalent postgraduate qualification formally recognized in their jurisdiction of residence.
  61. In addition to educational requirements, all therapists must either (i) hold a valid Disclosure and Barring Service (DBS) certificate, or an equivalent background clearance issued by the competent authority in their jurisdiction, or (ii) expressly consent to undergo such a screening facilitated by PSIQED prior to their active participation on the Platform.
  62. For the avoidance of doubt, therapists displayed on the Platform and its associated applications are identified by the professional titles and credentials officially recognized within their jurisdiction of practice, including, but not limited to, those of the United States, the United Kingdom, Germany, the Netherlands, France, and Australia.
  63. PSIQED exercises commercially reasonable diligence in verifying that therapists have presented evidence of meeting these eligibility criteria. However, PSIQED does not warrant, guarantee, or assume responsibility for the accuracy, completeness, or continued validity of the credentials, licenses, registrations, or background clearances provided by any therapist. The obligation to maintain current registration, valid licensure, good professional standing, and compliance with applicable national laws rests exclusively with the therapist.
  64. By accepting these Terms, you acknowledge and agree that:
  65. 1.PSIQED is a technology platform that facilitates access to independent psychological life coaching services; it does not employ therapists nor provide therapy itself.
  66. 2.Any misrepresentation, omission, or failure by a therapist to disclose relevant information lies solely within the responsibility of that therapist, and PSIQED shall bear no liability in connection therewith.
  67. 3.Clients are encouraged to exercise their own due diligence when engaging with therapists through the Platform.
  68. 8. Your Rights
  69. Under UAE PDPL and GDPR principles, you have the right to:
  70. Access your data.
  71. Request rectification or erasure.
  72. Restrict or object to processing.
  73. Data portability (where applicable).
  74. Withdraw consent at any time (without affecting prior lawful processing).

  76. 8.1 Disclaimer of Warranty
  77. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY NATURE RESULTING FROM THE THERAPIST SERVICES OR THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE OF ANY THERAPIST AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM.
  78. YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM IS PROVIDED “AS IS&” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, NON-INFRINGEMENT, SECURITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY. THE USE OF THE PLATFORM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
  79. YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES.
  80. YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT OUR AGGREGATE LIABILITY FOR DAMAGES ARISING WITH RESPECT TO THIS AGREEMENT AND ANY AND ALL USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU OR ON YOUR BEHALF THROUGH THE PLATFORM IN THE 12 MONTHS PERIOD PRIOR TO THE DATE OF THE CLAIM.
  81. 8.2 Liability Disclaimer
  82. By using the Platform, you expressly agree and acknowledge that:
  83. All therapeutic responsibility lies with the independent professional providing the session.
  84. Blog articles and product recommendations are non-binding, non-clinical, and for educational purposes only.
  85. PSIQED bears no liability for decisions made based on Platform content outside of contracted counseling sessions.
  86. 9. Contact/Complaints

  88. Important Notes about our Agreement
  89. This Agreement and our relationship with you shall both be interpreted solely in accordance with the laws of the State of Delaware excluding any rules governing choice of laws.
  90. THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND US. YOU CONFIRM THAT YOU HAVE NOT RELIED UPON ANY PROMISES OR REPRESENTATIONS BY US EXCEPT AS SET FORTH IN THIS AGREEMENT.
  91. It is important to note that PSIQED acts solely as the provider of a platform enabling secure communication between clients and independent therapists. All therapeutic services are performed exclusively by the therapists, who are neither employees nor agents of PSIQED. Likewise, the mental health blog and any recommended items are offered solely for informational and educational purposes; they do not constitute medical or therapeutic advice, and PSIQED accepts no liability for reliance on such content.
  92. 10. Children & Minors
  93. The PSIQED Platform and its services are intended primarily for individuals aged 18 years and older. Use of the Platform by minors is permissible only where a parent or legal guardian has provided valid and verifiable consent in accordance with applicable law. Therapists may, at their discretion, require written evidence of such consent—such as signed declarations, identification documents, or proof of guardianship—prior to initiating any session.
  94. By granting consent, the parent or guardian acknowledges full responsibility for the minor’s engagement with the Platform, including session scheduling, financial obligations, and adherence to these Terms. The scope of this consent is limited to the specific services agreed upon and does not extend to any other use of the Platform. Therapists retain the professional discretion to decline or discontinue services to minors should the case fall outside the scope of life coaching or online psychological support, or where psychotherapy, psychiatric intervention, or medical care is deemed more appropriate.
  95. Parents and guardians may, upon request, obtain general information regarding session attendance and billing, but the confidentiality of session content is preserved in accordance with professional ethics and legal requirements. All services involving minors are conducted in strict compliance with UAE Federal Law No. 3 of 2016 (Wadeema’s Law), GDPR (where applicable), and other relevant international child protection standards.
  96. PSIQED assumes no liability for misrepresentation of age or fraudulent claims of parental consent. Responsibility for the accuracy of such representations rests solely with the registering parent or guardian, who undertakes to monitor and oversee the minor’s use of the Platform.
  97. In relation to financial obligations, you agree that an initial consultation shall be billed at €250. In the event of a late cancellation occurring within forty-eight (48) hours of a scheduled session, you shall remain liable for a cancellation fee of €100. In the event of a failure to attend without any cancellation (“No Show”), you shall remain liable for the full consultation fee of €250. By booking through the Platform, you consent to such fees being charged via your registered payment method and recognize that these terms are material to the operation of the Platform and the reasonable reliance of independent professionals upon confirmed engagements.
  98. 11. Governing Law
  99. This Privacy Policy, and any dispute, claim, or controversy arising from or relating to it, shall be governed exclusively by and construed in accordance with the laws of the Dubai, United Arab Emirates, without regard to conflict-of-law principles.
  100. You irrevocably agree that the courts of Dubai shall have exclusive jurisdiction over any proceedings, actions, or disputes connected to this Policy or your use of the Platform. By using the Platform, you expressly waive any objection to venue or jurisdiction in those courts, including objections based on forum non conveniens or similar doctrines.
  101. 12. Policy Updates
  102. We reserve the right, in our sole discretion, to amend, revise, or otherwise update this Privacy Policy at any time in order to reflect evolving legal, regulatory, operational, or technological requirements. Any such modifications shall become effective upon publication, unless a later effective date is specified. Where applicable law requires, we will provide prior notice of material changes through reasonable means, which may include direct communication (e.g., email), in-platform notifications, or prominent publication on the Platform.
  103. By continuing to access or use the Platform following the effective date of any updates, you are deemed to have read, understood, and accepted the revised Policy in its entirety. If you do not agree with the amended terms, you must immediately discontinue all use of the Platform. Your continued engagement constitutes binding acceptance of the revised provisions.
  104. For avoidance of doubt, no failure or delay in providing notice shall invalidate the enforceability of updates that are required to comply with applicable law, court orders, supervisory authority guidance, or to address urgent security, safety, or operational risks.
  105. Our Platform may contain links to third-party websites, applications, stores, products, or services (collectively, “External Links”). These External Links are provided solely for convenience or informational purposes. We do not control, endorse, monitor, or assume responsibility for any External Links, including their content, availability, privacy practices, security, or terms.

    • No endorsement / no warranty. Inclusion of a link does not imply endorsement. We make no representations or warranties—express or implied—regarding any External Link, and we disclaim any liability arising from your use of, or reliance on, such resources.

    • Separate policies apply. External Links are governed by the third party’s own terms and privacy policies. You are responsible for reviewing those documents before engaging with the third party or providing any personal data.

    • Affiliate references. From time to time, we may reference or recommend third-party products (e.g., books or wellness items). Any such references are strictly informational. If affiliate identifiers or tracking parameters are used, they operate only to attribute referrals and do not permit us to access your payment card details.

    • Your responsibility. Accessing External Links is at your sole risk. You should exercise due diligence, including assessing suitability, safety, credentials, and regulatory status of the third party before purchase or use.

    • No data sharing without basis. We do not disclose your health-related information to External Links. If any limited technical data (e.g., UTM parameters or anonymized analytics) is used for referral attribution, it is handled in accordance with this Policy and applicable law.

    If you believe an External Link featured on our Platform is unsafe or inappropriate, please notify us at contact@psiqed.com so we can review it.

  106.  13. Cancellation Policy

  107. All appointments booked through the PSIQED Platform constitute binding professional engagements between the client and the independent therapist. Because each appointment reserves time that cannot reasonably be reassigned on short notice, cancellations and failures to attend create tangible losses. For this reason, clients may cancel or reschedule a session at no cost only if notice is given at least forty-eight (48) hours before the scheduled start time. If a cancellation or rescheduling request is made within fewer than forty-eight (48) hours, the client will be charged a cancellation fee of one hundred euros (EUR 100), regardless of the reason, unless the therapist, at their sole discretion, accepts that a bona fide emergency justifies a waiver. In the event of a non-attendance, defined as failure to appear for the session without prior notice, the full session fee becomes immediately due. For initial consultations, this means that the client will be charged the entire amount of two hundred fifty euros (EUR 250).

    These charges are expressly agreed by the client to represent liquidated damages rather than penalties. They reflect a genuine and reasonable pre-estimate of the loss suffered as a result of cancellations and no-shows, including lost professional time, preparation, and opportunity costs. By booking an appointment, the client authorizes PSIQED and its payment providers, including but not limited to Stripe and PayPal, to debit these amounts directly from the client’s stored payment method. Clients bear sole responsibility for maintaining valid and sufficient payment information on the Platform at all times.

    Any waiver or reduction of fees in cases of documented emergencies is entirely discretionary and does not establish any precedent or obligation for future cases. Failure by PSIQED or a therapist to enforce this policy on a given occasion shall not be construed as a waiver of the right to enforce it thereafter. This Cancellation and No-Show Policy is an integral part of PSIQED’s Terms and Conditions and is governed exclusively by the laws of Dubai, United Arab Emirates. By confirming a booking, the client acknowledges and accepts these terms in full.

  108. 14. Final Provisions

    For the avoidance of doubt, and notwithstanding anything to the contrary contained in this Agreement, the following provisions shall govern the full extent of PSIQED’s liability, the rights and responsibilities of users, and the binding nature of this Agreement.

    You expressly acknowledge and agree that PSIQED operates solely as a digital technology provider and facilitator of access to independent professionals. PSIQED is not itself a healthcare provider, employer, guarantor of therapeutic outcomes, or certifying body of professional competence. All therapeutic, counseling, and coaching services are rendered exclusively by independent professionals (“Therapists”) who are neither employees, agents, nor representatives of PSIQED. Responsibility for professional licensure, regulatory compliance, ethical practice, and the accuracy or validity of any credential, degree, or clearance rests exclusively with the Therapist. PSIQED exercises commercially reasonable diligence in verifying therapist qualifications but expressly disclaims any duty to warrant, supervise, or guarantee their continued validity, sufficiency, or compliance. Any misrepresentation, omission, or failure by a Therapist to disclose relevant information shall give rise solely to liability of the Therapist and shall not, under any theory, impose liability upon PSIQED.

    You further acknowledge that PSIQED’s role is limited to providing technological infrastructure for telehealth communication (currently via Doxy.me), appointment scheduling, and payment processing. Technical reliability is contingent upon third-party providers, telecommunications infrastructure, and factors beyond PSIQED’s reasonable control. Accordingly, PSIQED disclaims liability for service interruptions, transmission errors, cyber-attacks, unauthorized access, or technical malfunctions, whether arising from Doxy.me, payment processors (including Stripe or PayPal), hosting providers, or other external vendors. PSIQED shall not be liable for damages, losses, or interruptions caused by force majeure events including, but not limited to, natural disasters, acts of terrorism, pandemics, governmental orders, regulatory interventions, or unforeseen technological breakdowns.

    All blog articles, digital resources, product recommendations, and affiliate content accessible via the Platform are provided solely for general informational and educational purposes. They do not constitute medical or therapeutic advice, are not a substitute for in-person care, and should not be relied upon for diagnosis, treatment, or urgent decision-making. PSIQED does not endorse, manufacture, or warrant any external products or services and shall bear no responsibility for losses, side effects, or damages arising from reliance upon such materials. Engagement with external links or third-party content is undertaken entirely at the user’s discretion and risk.

    To the fullest extent permitted by applicable law, you agree that PSIQED shall not be liable to you or any third party for any indirect, incidental, consequential, punitive, exemplary, or reliance damages, including without limitation damages for emotional distress, data loss, service interruption, unauthorized access, business interruption, loss of profits, reputational harm, or any other non-economic loss, whether arising in contract, tort, equity, statute, or otherwise. In all cases, PSIQED’s total aggregate liability shall not exceed the total amount actually paid by you to PSIQED in the twelve (12) months immediately preceding the occurrence giving rise to liability. This limitation forms a fundamental basis of the contractual exchange between you and PSIQED, without which PSIQED would not make the Platform available.

    You further agree to indemnify, defend, and hold harmless PSIQED, its officers, directors, affiliates, contractors, and employees, from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (i) your breach of these Terms, (ii) your use of the Platform or Therapist Services, (iii) your violation of applicable laws, regulations, or rights of third parties, (iv) disputes arising directly between you and any Therapist, or (v) misuse of blog content, affiliate links, or third-party products.

    This Agreement shall be governed exclusively by and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to principles of conflict of laws. You irrevocably submit to the exclusive jurisdiction of the courts of Dubai for the resolution of any dispute, action, or claim arising out of or relating to this Agreement, and you expressly waive any objection to venue or jurisdiction in those courts, including objections based on forum non conveniens or similar doctrines.

    This master provision, together with all disclaimers, indemnities, and limitations of liability contained herein, shall survive termination or expiration of this Agreement and remain enforceable to the maximum extent permitted by law. By continuing to use the Platform, you confirm that you have read, understood, and voluntarily accepted these limitations as binding conditions of access, and you acknowledge that PSIQED would not otherwise provide you access to the Platform absent these protections.

  109. 15. Enforcement

    All financial obligations arising from the booking, cancellation, attendance, or non-attendance of sessions arranged through the PSIQED Platform (the “Platform”) constitute binding contractual duties of the client. By confirming a booking, the client irrevocably accepts and undertakes to comply fully with the payment terms set out herein.

    Sessions that take place are invoiced immediately and must be paid in full upon completion via the approved payment channels integrated into the Platform. PSIQED does not extend credit facilities, nor does it permit deferred payments, except where expressly agreed in writing in advance.

    Where a client cancels a scheduled session less than forty-eight (48) hours before the appointed start time, the client is liable to pay a cancellation fee of one hundred euros (€100), payable within twenty-four (24) hours of cancellation. Where a client fails to attend (“no-show”), the full fee of two hundred and fifty euros (€250) becomes immediately due and payable within twenty-four (24) hours of the scheduled start time. These provisions are necessary to safeguard the time and professional commitment of therapists.

    Failure to remit any payment within twenty-four (24) hours of cancellation, no-show, or session completion constitutes a material breach of contract. PSIQED may issue written reminders and payment demands in such cases. Each reminder generates a separate administrative charge of forty-five euros (€45), which is automatically added to the outstanding balance. This fee accrues cumulatively for every reminder issued until full payment is received.

    If a client persistently fails or refuses to pay, PSIQED shall impose an additional contractual penalty of five hundred euros (€500). This penalty is a genuine pre-estimate of the liquidated damages caused by the administrative burden, reputational harm, and operational disruption arising from client default. It accrues immediately upon formal notification of refusal to pay and is enforceable in addition to all outstanding fees, cancellation/no-show charges, and administrative reminder costs.

    PSIQED reserves the right, at its sole discretion, to suspend, restrict, or permanently block a client’s access to the Platform and its services until all outstanding amounts—including fees, cancellation charges, reminder costs, and penalties—are paid in full. Such suspension does not relieve the client of their financial obligations under these Terms.

    In cases of continuing default, PSIQED may escalate matters to external collection agencies and/or initiate legal proceedings in the courts of Dubai, United Arab Emirates. In such proceedings, PSIQED shall claim not only the principal debt, administrative fees, and contractual penalty, but also statutory or contractual interest, full legal costs, and all enforcement expenses. The client acknowledges and agrees that they are liable for such costs on a full indemnity basis.

    By accepting these Terms, the client confirms that all provisions relating to payment, cancellation, no-show penalties, administrative fees, and the contractual penalty are reasonable, proportionate, and legally enforceable. The client further waives any right to contest these provisions on grounds of proportionality or enforceability in any forum, and expressly accepts them as binding liquidated damages rather than unenforceable penalties.

    Finally, PSIQED reserves the right to report repeated or deliberate refusal to pay to competent authorities and, where applicable, professional regulatory bodies. Such reporting shall be undertaken in strict compliance with data protection laws but may include disclosure of identifying details where necessary for the protection of PSIQED’s rights.
